In May a court in Florida ruled that the law on loud stereos was unconstitutional. Florida Statute 316.3045 lets cops stop a motor vehicle if a stereo is “plainly audible at a distance of 25 feet or more” though it makes exceptions for businesses and politicians.
The statute was challenged by Clearwater attorney Richard Catalano and Alexander Schermerhorn, another resident in West Florida, leading to the ruling by the Second District Court of Appeal in Lakeland that was deemed unconstitutional.
The argument is that “plainly audible” is too vague and the exceptions for business and politicians are unfair. One of the main arguments against the law is that it is basically profiling and used to give the officers an excuse for unreasonable searches and seizures.
Don’t think that you can boom your system just yet though, since the law is in appeal agencies still can choose to enforce it until the supreme court of Florida rules.
